HB1355 Will it work?

The Colorado assembly  wanted to address the healthcare crisis and put a band aid on part of the problem, rising healthcare premiums.  However, they used an infected dressing. HB1355 will eliminate the 10% increase that small groups may receive based on claims and health risk questions but these are a minority of groups. Most small companies receive some type of discount on their group health insurance which they will still be entitled to in 2008 but those discounts go away in 2009. Where is the incentive to encourage wellness?
Community rating sounds very fair. I wish my other insurance was that fair. I received a minor driving ticket and my car insurance went up. If I had a claim on my home owners policy, that rate would go up. Where is the fairness?
Insurance is not based on fairness but on risk and you can only assess risk knowing prior history. Putting all groups into one large risk pool and charging everyone the same rate will chase away healthy groups and eventually the pool will have only the "sick" groups.
But by then, most of those that voted for this ill conceived bill may be out of office.
